Biden’s New Border Policy Faces Immediate Legal Challenge from Texas and Coalition of States

The Biden administration’s new border policy is facing immediate legal action. Texas is leading a coalition of states. They filed a lawsuit against the federal government. The policy seeks to limit asylum claims. It also aims to quickly remove migrants who cross the U.S.-Mexico border illegally. This legal battle highlights the deep divisions over immigration enforcement.

Understanding Biden’s Border Policy

President Joe Biden announced the new policy earlier in June. It allows for expedited removals of migrants. This happens when daily illegal border crossings reach a certain threshold. The policy enables authorities to deport migrants quickly. These individuals are barred from seeking asylum. The measure specifically targets those who cross between ports of entry. They cannot claim fear of return unless they meet strict criteria. This policy uses authority from Section 212(f) of the Immigration and Nationality Act. It mirrors strategies used by previous administrations.

The administration implemented these rules to manage rising migrant encounters. Officials said the border system was overwhelmed. They argued for stricter enforcement measures. The policy activates when average daily encounters hit 2,500. It deactivates once the average drops to 1,500. This threshold has not been met since 2020. Therefore, the policy has been active since its inception.

Texas Leads the Legal Charge

Texas Attorney General Ken Paxton announced the lawsuit. Louisiana, Arkansas, Mississippi, Montana, and Oklahoma joined Texas. The lawsuit was filed in a federal court in Del Rio, Texas. This court is known for hearing border-related cases. The states argue the new rules are unlawful. They claim the policy violates the Administrative Procedure Act (APA).

The lawsuit states the policy is arbitrary and capricious. It also argues the federal government did not follow proper rulemaking procedures. Texas claims the policy does not prevent illegal immigration. Instead, the state suggests it encourages more crossings. This increases the burden on Texas’s resources. Such claims are common in border-related litigation.

Arguments Against Biden’s Policy

Opponents, including civil rights groups, have criticized the policy. The American Civil Liberties Union (ACLU) called it a ‘ban on asylum.’ They argue it unlawfully restricts access to protections. Asylum is a right under both U.S. and international law. Critics say the policy creates a ‘near-total’ shutdown of asylum. This is regardless of a person’s individual circumstances.

Republican leaders also expressed concerns. They claim the policy does not go far enough. Some argue it is a political move. They believe it aims to show action before the presidential election. These lawmakers demand even stricter measures. They believe the current administration has failed on border security. This political division complicates any potential solutions.

Administration’s Defense and Broader Context

The Biden administration defends its actions. Officials state the policy is necessary. They highlight the need for a more orderly border. They also point to previous efforts. These include increased resources and technology for border patrol. President Biden has repeatedly called on Congress to pass comprehensive immigration reform.
