Trump Eyes New Iran Policy: ‘State Sponsor of Wrongful Detention’ Designation

Former President Donald Trump is reportedly considering a new policy toward Iran. If re-elected, his administration may label Iran a “state sponsor of wrongful detention.” This designation would be a significant shift in U.S. foreign policy. It could also impact Americans held captive abroad.

What the Designation Means

The “state sponsor of wrongful detention” label is a relatively new tool. It was created by the 2020 Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act. This act aims to combat the unjust detention of U.S. citizens. Currently, there are no countries officially designated under this law. However, Iran frequently detains Americans. U.S. officials consider these detentions wrongful.

The designation carries specific implications. It would require the U.S. government to take stronger actions. These actions would target officials involved in hostage-taking. Additionally, it would mandate reports to Congress. These reports would detail efforts to secure the release of U.S. detainees.

Potential Sanctions and Diplomatic Impact

Implementing this designation would likely lead to new sanctions. These sanctions would target individuals and entities tied to wrongful detentions. Furthermore, it could complicate diplomatic efforts. It might also reduce the ability for prisoner exchanges. Previous exchanges have secured the freedom of several Americans from Iran. Such a move could make future negotiations more difficult.

Meanwhile, the Trump campaign has not confirmed these specific plans. However, a spokesperson indicated a tougher stance on Iran. They stated that a Trump administration would prioritize bringing Americans home. They also pledged to hold those responsible for wrongful detentions accountable. This suggests a continued hardline approach to Iran.

Focus on Detained Americans

Several U.S. citizens are currently imprisoned in Iran. Their families often lobby the U.S. government for their release. The proposed designation aims to increase pressure on countries like Iran. It seeks to deter them from detaining U.S. nationals. However, some critics worry it could also make these detainees more valuable. This might prolong their captivity.

Former U.S. officials familiar with the discussions confirmed these internal considerations. They noted that the designation is part of broader policy discussions. The overall goal is to address Iran’s actions. This includes its nuclear program and regional activities.

Comparing Administrations’ Approaches

The Biden administration has also worked to free Americans from Iran. In 2023, it secured the release of five U.S. citizens. This was part of a deal. The deal involved unfreezing $6 billion in Iranian oil revenue. This revenue was then moved to restricted accounts in Qatar. The funds were solely for humanitarian purposes. This approach contrasts with the potential Trump policy. The Trump plan focuses more on punitive measures.

In addition, the Biden administration has sought to use a mix of diplomacy and sanctions. Their strategy aims for de-escalation where possible. Conversely, a Trump administration might adopt a more confrontational stance. This could further strain U.S.-Iran relations. The outcome for wrongfully detained Americans remains a central concern.
